"Now that the Federal government has been told that they cannot deny the right of marriage to anyone, Constitutional precedent has been set. It won't be long until we see challenges in the states that have anti-equality bans on the books. In citing the Fifth Amendment's equal protection to all, it seems like a rather open and shut case that any state law banning same-sex marriage would violate the Fifth Amendment. According to Article VI, Clause 2 of The Constitution, no state law can trump a Federal law, and so guess what? All those homophobic and bigoted laws on the books? They're all unconstitutional now. The DOMA ruling was not based on states' rights, it was based on human rights, and therefore the legal precedent is clear, the pathway is open, and within less than half a decade, I can't see why marriage equality won't be the law of the land in all 50 states.
